Becomes Warning for KPK
Vice President Jusuf Kalla said the Supreme Court's decision to acquit the defendant
of the corruption case for the elimination of Bank Indonesia Direct Assistance
(BLBI) receivables, Syafruddin Arsyad Temenggung, was a warning to the
Corruption Eradication Commission (KPK) in the screening of prospective
competent leaders.
"Indeed, this case
is important, it is also a warning to the KPK to really fulfill all the
provisions and be careful to fulfill the requirements of prospective commissioners
," Vice President JK told reporters at the Jakarta Vice President's Office
on Wednesday (7/19).
The Vice President said
that the Supreme Court's decision to grant the cassation of the former head of
the Bank Restructuring Agency (IBRA) was a legal product that must be respected
by all parties. "That is the authority of the Supreme Court that we must
respect. Although it is also true that not 100 percent the judge at the Supreme
Court agree. But we must respect the decision, after all," he added.
The BLBI case has been in
process for almost 20 years and is nearing expiration. So if there are parties
who want to appeal the Supreme Court verdict, Vice President JK said, it is
expected they must be able to think about the impact on legal credibility in
Indonesia.
Jusuf Kalla reminded that the case of the
Bank Indonesia Liquidity Assistance (BLBI) has,for some time,expired.
"This is BLBI, which for almost 20
years has expired, and people [entrepreneurs and business actors who receive
liquidity assistance] need legal certainty," he said.
For that, said JK, law enforcers must
resolve this case immediately, including respecting the decisions of the judicial institution.
The Vice
President said if the Supreme Court's verdict was appealed again, there could be
distrust of legal certainty in Indonesia. "If it has been released so
according to the rules of law, then it is still being prosecuted again, later
the community or entrepreneurs or parties from overseas will say there is no
legal certainty in Indonesia. That is also important," he explained.
The MA ruling was
delivered by the Head of the MA Law and Public Relations Bureau, Abdullah, who
said that based on Syafruddin's decision, he must be released from all
lawsuits. Aside from being freed from legal entanglement, Syafruddin's
abilities, dignity and dignity must be restored and released from detention.
Syafruddin Temenggung
was proven guilty of a corruption case with a state loss of around Rp 4.58
trillion related to the issuance of BLBI Declaration (SKL) to the Indonesian
National Trade Bank (BDNI). The Jakarta Corruption Court (Tipikor) convicted
and gave Syafruddin a 13-year prison sentence. Syafruddin had appealed to the
DKI Jakarta High Court, and the application was rejected and the sentence was
reduced to 15 years in prison.
